O ministro do Supremo Tribunal Federal (STF), Ricardo Lewandowski, votou pela constitucionalidade da reserva de vagas em universidades públicas com base no sistema de cotas raciais. O magistrado é relator do processo ajuizado pelo DEM contra o sistema de cotas raciais da Universidade de Brasília (UnB).
De acordo com Lewandowski, os programas de ação afirmativa têm como finalidade acabar com o sentimento de discriminação por pertencer à determinada raça. “Não basta não discriminar. É preciso viabilizar. A postura deve ser, acima de tudo, afirmativa. É necessária que esta seja a posição adotada pelos nossos legisladores. A neutralidade estatal mostrou-se, nesses anos, um grande fracasso”.
Para o ministro, o reduzido número de negros e pardos que exercem cargos ou funções de relevo em nossa sociedade, tanto na esfera pública quanto na privada, resulta de uma discriminação histórica. “Os programas de ação afirmativa, em sociedades onde isso ocorre, são uma forma de compensar essa discriminação culturalmente arraigada e praticada de forma inconsciente”. Ele acredita que a instituição das cotas na UnB faz com que o ambiente acadêmico seja mais diversificado.
Segundo a ação proposta pelo DEM, o sistema de cotas viola preceitos fundamentais da Constituição. Para o partido, vão ocorrer “danos irreparáveis se a matrícula [nas universidades] se basear em cotas raciais, a partir de critérios dissimulados, inconstitucionais e pretensiosos”.
A UnB foi a primeira universidade federal a instituir o sistema de cotas, em junho de 2004. Atos administrativos e normativos determinaram a reserva de 20% das vagas oferecidas pela instituição nos certames de acesso (vestibular e Programa de Avaliação Seriada – PAS) a candidatos pretos e pardos.
A política de ação afirmativa faz parte do Plano de Metas para Integração Social, Étnica e Racial da UnB e foi aprovada pelo Conselho de Ensino, Pesquisa e Extensão da instituição. No primeiro vestibular, 18,6% dos candidatos optaram pelo sistema de cotas raciais. A eles foram destinados 20% das vagas de cada curso oferecido. A comissão que implementou as cotas para negros também foi responsável pelo convênio entre a UnB e a Fundação Nacional do Índio (Funai), firmado em 12 de março de 2004, para reserva de vagas a indígenas.
Após o voto de Lewandowski, a sessão foi suspensa e deve ser retomada hoje (26) à tarde.
O Supremo julga três ações relacionadas à reserva de vagas em universidades. A primeira foi protocolada pelo DEM, questionando o sistema de cotas adotado pela Universidade de Brasília, e a segunda é um recurso contra o sistema de cotas da Universidade Federal do Rio Grande do Sul.
A terceira ação contesta os critérios adotados pelo governo federal no Programa Universidade para Todos, o ProUni. O ProUni reserva uma parte das bolsas de estudos para negros, indígenas, pessoas com deficiência e alunos da rede pública.
